CDR (Call Detail Record) refers to the details of your calls. It includes:The number making the call, the number receiving the call, time, duration, cell tower location, etc.

It does not contain the call content (audio), only metadata.

Who is Authorized to Access CDR?In India, only the following entities are legally permitted to access CDR:Central or State Law Enforcement Agencies (LEAs):Police department officers of a specific rank (typically DCP/SP or above).

Agencies like Cyber Crime Cell, CBI, NIA, ED, etc.

Authorizing Authority:Written permission from the relevant police chief or designated senior official is required.

Legal Procedure for Obtaining CDRThe following steps must be followed to access CDR:Prepare a written request detailing the necessity for the investigation.

Obtain approval from a senior officer (SP/DCP or above).

Use the obtained CDR solely for investigation purposes.

Consequences of Unauthorized Access or Misuse of CDRIndian Telegraph Act, 1885 – Section 25: Unauthorized interference with telecom data can lead to up to 3 years of imprisonment, a fine, or both.

Indian Penal Code (IPC):Section 379 (Theft): Up to 3 years of imprisonment + fine.

Sections 419/420 (Cheating): 3–7 years of imprisonment + fine.

Sections 468/471 (Forgery/Misuse of Documents): Up to 7 years of imprisonment.

Key Points to NoteOrdinary individuals or private detectives have no legal right to access CDR.

Unauthorized access to CDR is a serious criminal offense.

If a telecom company employee provides CDR illegally, they face imprisonment and termination from service.

Even police or CID officers, unless specifically authorized, cannot access CDR, and doing so is considered an offense.
