Supreme Court Orders Release of All Prisoners Who Have Completed Their Sentence

If such persons are found, and they are not required in any other case, directions shall be issued for their release. "To ensure proper implementation of the judgment, the court also directed that copies of the order be provided to legal services authorities at the national, state, Union Territory, and district levels.

The Supreme Court recently directed all states and Union Territories to release prisoners who remain in jail despite having completed their sentence, as part of the ruling in the case Sukhdev Yadav alias Pehalwan vs. Government of Delhi [July 29, 2025].A bench comprising Justices B.V. Nagarathna and K.V. Viswanathan, in its judgment, instructed all states and Union Territories to review cases of prisoners detained beyond their sentence period and ensure their release.


The court emphasized: "The Registry of this Court shall forward a copy of this order to the Home Secretaries of all states and Union Territories to ascertain whether any accused or convict is detained in jail beyond the period of their sentence.
