Darshan, Pavithra Gowda Bail Cancelled: Supreme Court Highlights Flaws in High Court Order

Reading the order, Justice Mahadevan said, “The High Court’s order is fraught with serious contradictions. No special or cogent reasons were provided in the High Court’s order for granting bail. The court mechanically exercised its authority and overlooked critical legal facts.

New Delhi: In the Renukaswamy murder case, the Supreme Court has cancelled the bail granted by the High Court to actor Darshan, Pavithra Gowda, and five other accused, while pointing out several flaws in the High Court’s bail order. The bench, comprising Justices Pardiwala and R. Mahadevan, stated that it had considered all arguments related to the granting and cancellation of bail.

The High Court’s order was riddled with significant errors, the bench noted. Reading the order, Justice Mahadevan said, “The High Court’s order is fraught with serious contradictions. No special or cogent reasons were provided in the High Court’s order for granting bail. The court mechanically exercised its authority and overlooked critical legal facts. While granting bail, the High Court excessively considered the evidence of a case still under trial. Matters such as contradictions in statements and delays, which should be addressed by the trial court during witness cross-examination, were taken up by the High Court. Determining the credibility and reliability of witnesses is solely the responsibility of the trial court.”
