Karnataka High Court Imposes ₹2 Lakh Fine on Woman for Misusing Habeas Corpus Petition..!

The woman, Maheshwari M., claimed her son, Kriplani, was missing since July 7, 2025. However, the investigation revealed she was in contact with her son. The police informed the court that the petition was filed to harass them.

Bengaluru (Sep 8, 2025): The Karnataka High Court has imposed a ₹2 lakh fine on a 72-year-old woman for filing a habeas corpus petition with malicious intent, expressing dissatisfaction with the police investigation. The woman, Maheshwari M., claimed her son, Kriplani, was missing since July 7, 2025. However, the investigation revealed she was in contact with her son. The police informed the court that the petition was filed to harass them.

After reviewing the evidence, the court concluded that the woman had misused the judicial process with malicious intent. Justices Anu Sivaraman and Rajesh Rai K., in their verdict, stated, "To protect the judicial process, such frivolous petitions must be discouraged.

Therefore, a ₹2 lakh fine is imposed on the woman for concealing the truth and filing the petition with bad intent. "The fine is to be paid as follows: ₹1 lakh to the Karnataka Legal Services Authority and ₹1 lakh to the Karnataka Police Benevolent Fund. The court warned that failure to pay within two weeks will result in a contempt of court case.
