In a detailed order, Additional Chief Judicial Magistrate Vaibhav Chaurasia observed that the authority to include or remove a person from the voter list lies solely with the Election Commission of India. "Accordingly, the authority and power to determine an individual's eligibility for inclusion or removal from the voter list, along with any electoral offenses under the Representation of the People Act, 1950, the Representation of the People Act, 1951, and related rules, have been vested exclusively in the Election Commission of India," the judge stated.
