A bench comprising Justices Vikram Nath and Sandeep Mehta questioned how the SEC could act contrary to statutory provisions. The clarification issued by the SEC was deemed to violate Sections 9(6) and 9(7) of the Uttarakhand Panchayat Raj Act, 2016, as noted by the High Court in July. The issue arose when Shaktiman Singh alleged that the SEC failed to properly scrutinize nomination papers, allowing candidates with names on multiple voter lists to contest elections, thereby compromising the integrity of the electoral process. Despite such irregularities, several candidates were permitted to participate, prompting complaints. The SEC had issued the clarification in response to these concerns, which the High Court subsequently stayed in a ruling by Chief Justice G. Narendar and Justice Alok Mehra.
The SEC challenged the High Court’s stay in the Supreme Court, but the apex court dismissed the appeal and upheld the fine, reinforcing that the SEC’s clarification contravened statutory norms.
