G.B. Pachaiyappan, representative of the trust Thondai Mandala Saandror Dharma Paribalana Sabha, alleged that TVK had copied the flag used by their trust to create the party's flag. However, the single-judge bench of the High Court had previously refused to grant an interim order restraining TVK from using the flag. The Madras High Court on September 26, 2025, sought the response of actor and politician Vijay, along with his political party Tamilaga Vettri Kazhagam (TVK), in a trademark and copyright infringement case related to the party's flag [GB Pachaiyappan and Tamilaga Vettri Kazhagam case].

The Division Bench, comprising Justices G. Jayachandran and Mummineni Sudheer Kumar, heard the case on September 26 and directed Vijay and his party to file their response. The matter is scheduled for further hearing after six weeks. The TVK flag, unveiled in August 2024, visually resembles the trust's registered trademark, which features a red-yellow-red tricolour with a distinctive central circular motif, as highlighted by the petitioners to the court. The petitioners sought a permanent injunction against TVK and actor/politician Vijay to restrain them from using the flag, ₹5 lakh in damages for trademark and copyright infringement, directions to the defendants to submit details of profits made through the alleged infringement, destruction of all infringing materials including printed flags, other items, and advertisements, and for the party and actor to bear the court's costs.

In earlier hearings, TVK refuted the claims, arguing that neither the trust nor the party operates in similar fields and that while there are some color similarities, the overall design, including symbolic elements like elephants and the Vaagai flower in maroon and yellow, is distinct with no risk of public confusion. The single judge noted no prima facie evidence of substantial copying or infringement.
