The court observed that the accused, along with another accomplice, committed a heinous act against a teenage girl who had dreams and aspirations for her future. This crime would leave an indelible scar on her life, and the trauma would make recovery extremely difficult for the victim. Quoting the Manusmriti verse and Mahatma Gandhi’s statement, "The day a woman can walk freely on the roads at midnight, that day India will truly achieve independence," the court refused to grant bail to the accused.

Case Background:
The 19-year-old victim, originally from Goragamma village in Banka district, Bihar, was staying with her sister and brother-in-law, who worked at a cardamom plantation in Kattappana, Kerala. Unwilling to continue working there, she decided to return to her hometown. On April 1, 2025, she traveled to Ernakulam railway station, where she was advised to board a train to Bengaluru and then proceed to Bihar from K.R. Puram station. Accordingly, she arrived at K.R. While walking with a male relative towards Mahadevapura to have a meal, the victim and her relative were intercepted and assaulted by the first accused and the appellant (Syed Parveez Musharraf). The first accused raped the victim while the appellant held her relative captive. Hearing the victim’s screams, locals gathered at the scene, prompting the first accused to flee. However, the appellant was apprehended by the public and handed over to the police.

A case was registered at the Mahadevapura police station. The trial court had previously rejected the accused’s bail application, leading him to file a criminal appeal in the Karnataka High Court seeking bail. The High Court’s dismissal of the appeal upholds the denial of bail, emphasizing the severity of the crime and its impact on the victim.
