The Allahabad High Court has ruled that the matrimonial website Shaad com is not responsible for users' actions [Case: Anupam Mittal vs. Governments of Telangana and Uttar Pradesh].The division bench, comprising Justices Siddharth Varma and Madan Pal Singh, stated that Shaadi . com, being an intermediary platform under the Information Technology (IT) Act, is exempt from liability.
In 2022, a complaint was filed against Anupam Mittal under various sections of the Indian Penal Code (IPC) and Section 67 of the IT Act, alleging that Shaadi . com failed to verify user details, leading to the platform being used to promote obscenity. A woman claimed that someone recorded her obscene video, threatened her, and attempted extortion through the website. She further alleged that Mittal and Shaadi . com’s customer service did not respond to her complaint.In its September 23 judgment, the court clarified that the website, as an intermediary platform, is not liable for verifying candidate details. The court noted, “The platform took action as soon as complaints were received. The intermediary, i.e., the company where the applicant is the CEO, is protected under Sections 79(1) and (2) of the IT Act and has not abetted any wrongdoing.”
