The Allahabad High Court on Saturday declined to issue an order restraining the demolition of the Sharif Gosulbara Ravan Buzurg Mosque in Sambhal, Uttar Pradesh. The mosque's management committee had filed a petition before Justice Dinesh Pathak, challenging the Tehsildar's order to demolish the mosque. However, the court rejected the petition.
Subsequently, the mosque committee sought permission to withdraw the petition with the liberty to file an appeal before the District Magistrate's court under Section 67(5) of the Uttar Pradesh Revenue Code, 2006, for alternative relief. The committee also requested interim protection for the mosque. The court advised the mosque management to file an appropriate application before the appellate court if interim protection was needed. The court clarified, “The petitioners are at liberty to file an appropriate application before the appellate court regarding interim protection. If such an application is filed, the appellate court shall decide it on its merits, unaffected by this order.” It is alleged that the mosque was constructed on a compost pit/pond site. The mosque committee had previously sought four days to pursue legal remedies, and authorities had temporarily postponed the demolition.
