Bikl Shivar Murder Case: Government Files Petition to Cancel Protection Order for Bairati Basavaraj

In this case, Basavaraj, the fifth accused, had submitted a petition to quash the August 12 order issued by the CID Director General, which authorized subordinate CID officers to invoke Sections 3 and 4 of the Goonda Control Act (GOCA). Justice S. Sunil Dutt Yadav's single-judge bench conducted hearings on the matter.

Bengaluru: In the murder case of rowdy Sheethar Shivaprakash alias Bikl Shivar, the Crime Investigation Department (CID) police filed a petition in the Karnataka High Court on Thursday, seeking to cancel the interim protection order that bars the arrest of KR Puram MLA Bairati Basavaraj.

State Additional Government Advocate B.N. Jagadish, appearing for the government, argued that "the interim protection order granted to Bairati Basavaraj must be vacated."In response, senior advocate Sandeep Chout, representing the MLA, mounted a strong defense. "The High Court has already issued an interim order directing investigation officers not to arrest Basavaraj. The police had issued summons twice, and he duly appeared for questioning, providing the necessary cooperation. https://dv7jujfts4bjf.cloudfront.net/Untitled design - 2025-10-24T080142.136.png_2025-10-24T02:32:24.619Z

Despite this, it is unjust for the CID police to claim that 'he is not cooperating with the investigation and must be arrested for interrogation,'" he submitted to the bench."The petitioner is always ready to cooperate with the CID police investigation. If informed of the required appearance time, the petitioner will comply accordingly. We are prepared to appear at any time from morning till evening. Moreover, invoking the sections of the Goonda Control Act is unlawful," Sandeep Chout stated.

After considering arguments from both sides, the court extended the interim order and postponed the hearing to October 30. In the interim, the prospect of Basavaraj's arrest remains blocked, with all parties remaining vigilant for further developments in the case.
