Supreme Court Orders CBI Probe Into Rising Digital Arrest Scams Across India!

To curb incidents like digital arrests, the Supreme Court had in October suo motu registered a case. It had stated that this is a matter of people having trust in the judiciary.

In a significant move to curb the growing menace of digital arrest scams, the Supreme Court of India on Monday (Dec 1) issued a strong directive ordering the Central Bureau of Investigation (CBI) to conduct a nationwide investigation into these fraudulent activities.

The apex court had earlier, in October, taken suo motu cognisance of the alarming rise in digital arrest incidents, stating that such scams directly affect public trust in the judiciary and law enforcement.

CBI Granted Full Freedom to Investigate Nationwide

Delivering its order, the Supreme Court instructed the CBI to begin a comprehensive probe into digital arrest rackets reported across the country. Emphasizing the seriousness of the issue, the court clarified that the CBI would have complete autonomy in conducting the investigation.

Importantly, the bench directed that even states that traditionally do not grant consent for CBI investigations must cooperate in this case, ensuring that the probe faces no jurisdictional hurdles.

Bench Flags Growing Cyber Fraud Linked to Jobs and Investments

The order was passed by a bench comprising Chief Justice Surya Kant and Justice Joymalya Bagchi, which reviewed submissions made by amicus curiae Amit Sahni. The issues highlighted included:

Digital arrest scams

Part-time job frauds

Online investment-related cyber scams

These fraudulent schemes have reportedly swindled victims across India, often by impersonating law enforcement officials and coercing victims through fear. Digital Arrest Cases to Be Given Top Priority

According to the court’s directive, the CBI must first prioritize cases specifically related to digital arrest frauds, given their rapid spread and severe impact on citizens. Investigations into other cyber fraud cases will follow in subsequent phases.

The Supreme Court’s intervention marks a crucial step in tackling one of India’s fastest-growing cybercrime trends, offering hope for stronger enforcement and better protection of citizens from digital exploitation.
