It has been reported that the Allahabad High Court has transferred the citizenship-related petition faced by Leader of the Opposition Rahul Gandhi to another court.

The Allahabad High Court has transferred the trial of a criminal case against the Leader of the Opposition in the Lok Sabha, Rahul Gandhi, regarding allegations of holding British citizenship, from Raebareli to Lucknow.

Reason for Transfer of the Case

The complainant, S. Vignesh Shishir, informed the court that Rahul Gandhi’s supporters and local lawyers were preventing him from presenting arguments in the Raebareli court. Since Rahul Gandhi is the sitting Member of Parliament (MP) from the Raebareli constituency, Justice Brij Raj Singh acknowledged that the local atmosphere was not conducive to a fair trial. The High Court opined that, in the interest of justice, it is appropriate to transfer the case to a Lucknow court. Background of the Allegations

The complaint against Rahul Gandhi was filed by S. Vignesh Shishir.

The complainant alleges that in the records of a UK-based company named 'Backops Limited', Rahul Gandhi declared his nationality as 'British'. It is argued that this is a violation of Indian law. The petition seeks the registration of a criminal case under various sections of the Official Secrets Act, the Passport Act, and the Foreigners Act.

Key Highlights of the Court Order

1. Direction to CJM Court: The case, which was pending before the Additional Chief Judicial Magistrate (Court for Elected Representatives) in Raebareli, has now been transferred to the Special Court for Elected Representatives in Lucknow.

2. Regarding the Absence of Notice: The court stated that there was no need to issue a notice to Rahul Gandhi at this stage. The petitioner's counsel argued that since the complaint has not yet reached the FIR stage, Rahul Gandhi is not legally an 'aggrieved person' at this point.
