Big Relief from Supreme Court for Bagepalli MLA S.N. Subbareddy: High Court Order Stayed

The Supreme Court today stayed the Karnataka High Court order that had disqualified the election of Congress MLA S.N. Subbareddy from the Bagepalli assembly constituency.

BAGEPALLI: The Supreme Court today stayed the Karnataka High Court order that had disqualified the election of Congress MLA S.N. Subbareddy from the Bagepalli assembly constituency. With this, Subbareddy's position as an MLA remains secure for the time being.

What happened in the Supreme Court?

Significant Observation: A bench led by Justice Surya Kant, while hearing the petition, observed that there is a need for a detailed examination regarding whether "disclosing income alone is sufficient or if complete business details must also be revealed."

Notice Issued: The court directed the respondent, C. Muniraju, to file an objection within 6 weeks and adjourned the next hearing to September.

Background of the Case:

The Allegation: BJP candidate C. Muniraju had approached the High Court, alleging that during the 2023 elections, Subbareddy had suppressed his asset details and submitted a false affidavit.

High Court Verdict: Justice M.G.S. Kamal’s bench, after conducting the hearing, had declared the MLA's election null and void. However, the court had refused to declare the runner-up, Muniraju, as the winner.

Appeal to Supreme Court: Subbareddy challenged the High Court's verdict by filing an appeal in the Supreme Court.

2023 Election Results:

S.N. Subbareddy (Congress): 82,000 votes.

C. Muniraju (BJP): 62,000 votes.

Winning Margin: Approximately 20,000 votes.

Next Steps:

Since the Supreme Court has stayed the High Court's order, Subbareddy will continue to serve as the MLA. The final hearing scheduled for September will determine the future course of this case.
