Tel Aviv has passed a new and extremely controversial law applicable in Israel Jurisdiction. The law passed on March 30th, reinstates the death penalty for individuals convicted of terr0orist act that leads to the deaths of Jews. The law becomes more significant in Israeli jurisprudence because of the fact, Israel has given only one death penalty or capital punishment in their history, post World War 2. The only case of Capital punishment pronounced by Israeli Court was in the year 1962, was given against war criminal Adolf Eichmann.

Crucial provisions in the new law.

The law makes the death penalty default for Palestinians convicted in military courts of overseas lethal attacks. If the Judge wants to pronounce the life imprisonment, the case should prove the special circumstances.

Israeli civilian court allows death penalty or life imprisonment to any action taken deliberately to end Israel’s existence.

The execution of hanging to be performed within 90 days from the judgement pronounced.

 

No Clemency at all! The legislation has removed right to a pardon sentenced under terror act.

Most importantly whenever the capital punishment id pronounced it should be consulted with couple of benches and judges. Withy this law the three-judge panel can unanimously pronounce the death penalty.

Political context

Opposition and Arab have called it barbaric and discriminatory and it targets one particular ethnic group. European Union and Amnesty international have condemned the new law.
