Advocate K.V. Dhananjay has issued a clarification through a media statement regarding the Public Interest Litigation (PIL) filed in the Supreme Court. The petitioners sought the court's intervention, but no FIR had been registered in this matter at the time of filing. The Supreme Court dismissed the writ petition solely on the grounds of delay in filing, without examining the merits of the allegations. The court explicitly stated that it did not issue notices to any respondents or the state government and did not pass any judgment on the merits of the case.
The dismissal was purely due to the delay and not based on the substance of the petition. Therefore, the court's order has no bearing on the merits of the case.A complaint was lodged at the Dharmasthala Police Station on July 3, 2025, based on which an FIR was registered. The state government constituted a Special Investigation Team (SIT) to probe the matter. These actions align with established legal principles. Under the law, the police have a statutory duty to investigate cognizable offenses, and as per constitutional law, the state government has the authority to form an SIT and entrust it with the investigation. The Supreme Court's order did not dismiss the PIL on its merits but only on the grounds of delay. Thus, the order does not prevent the complaint, FIR, or SIT investigation from proceeding. The court clearly recorded that its order does not reflect any decision on the merits of the case and contains no elements that obstruct the FIR or SIT probe. The allegations made by the complainants appear serious and disclose a cognizable offense, prompting the formation of the SIT. As an advocate, my duty was to ensure that an investigation is initiated based on the complaint. This case primarily rests on the complainants' statements. I have publicly stated that if any of the complainants' statements are found to be false, legal action will be taken against them.
