In the POCSO case, the petition filed by B.S. Yediyurappa seeking the dismissal of the case has faced a setback, and the hearing has been postponed to October 23. As the arguments presented by Yediyurappa’s lawyer lacked clear and specific points, the court has directed them to provide explicit answers in the next hearing.

Former Karnataka Chief Minister and senior BJP leader B.S. Yediyurappa (BSY) faced a setback today as the Karnataka High Court adjourned the hearing of his petition seeking to quash the POCSO (Protection of Children from Sexual Offences) case filed against him to October 23. The court postponed the matter after finding that the arguments presented by Yediyurappa’s legal counsel lacked specific and comprehensive details on certain crucial aspects of the case.

During the proceedings, the single-judge bench of Justice M.I. Arun, which was also hearing related petitions filed by co-accused in the case, made a significant oral observation. The court suggested that the question of admitting the petition seeking to quash the proceedings based on the lower court's cognizance order might not even arise. This marks the second time the application has faced a setback.

Senior Counsel C.V. Nagesh, arguing for Yediyurappa, focused his submission narrowly on the need for the court to consider the victim’s statement and the statements of those present at the scene of the alleged crime. However, the court noted that arguments on other key issues were not specifically addressed.

In his plea, Advocate Nagesh had argued that Mr. Yediyurappa did not admit to the sexual assault, and that the trial court's decision to take cognizance of the case merely based on the victim’s statement was illegal.

The court has adjourned the proceedings to October 23, providing the defence an opportunity to secure answers from Senior Counsel C.V. Nagesh regarding the specific points raised. There are strong indications that the petition could be dismissed if comprehensive arguments on all required aspects are not presented at the next hearing.
