Under the new rule of the Trump administration, immigrant workers applying for EAD renewal after October 30, 2025, will no longer receive automatic extensions. This decision is likely to have a direct impact on thousands of Indian immigrant employees working in America.

The Trump administration has moved to end the policy of automatically extending Employment Authorization Documents (EADs) for certain categories of immigrant workers, a decision that is expected to significantly impact thousands of foreign nationals working in the United States, particularly those from India.

The Department of Homeland Security (DHS) announced on Wednesday that migrant workers who file an application for EAD renewal after October 30, 2025, will no longer receive the automatic extension of their work permits. India constitutes a large segment of the immigrant workforce in the US, making this change a direct concern for many Indian nationals.

Key Details of the Policy Change:

  • Effective Date: The new rule applies to EAD renewal applications filed after October 30, 2025.

Previous Extensions Unaffected: EADs that were automatically extended prior to October 30, 2025, will not be affected by this change.

This decision overturns the previous policy under the Biden administration, which allowed eligible immigrants to continue working in the U.S. for up to 540 days past their work permit's expiration date, provided certain conditions were met. These conditions included timely submission of the renewal application, the EAD category being eligible for automatic extension, and the current EAD category matching the eligibility category listed on the receipt notice or the requested category.

The DHS statement indicated that limited exceptions exist, such as extensions provided by law or through a Federal Register notice for TPS-related employment documentation.

The government asserts that the change will require more frequent background checks of immigrant workers, which will assist the U.S. Citizenship and Immigration Services (USCIS) in "preventing fraud and identifying foreign nationals with harmful intent."
