Despite intense resistance from opposition parties and LGBTQ rights activists, President Droupadi Murmu has granted her assent to the Transgender Persons Amendment Bill, 2026.
Having cleared both houses of Parliament on March 25, this bill has now officially become law, marking a significant and controversial shift in India’s legal landscape.
Abolition of Self-Identification: The new law repeals Section 4(2) of the 2019 Act, which previously allowed individuals to self-identify their gender based on their personal perception.
Narrowed Definition: Under the new criteria, "Transgender" status is restricted to those belonging to specific socio-cultural communities, intersex individuals, and those who have undergone sex-reassignment surgery (SRS).Shining Diva Fashion Latest Stylish Rose Gold Tulip Design Earrings Necklace Jewellery Set For Women (10103s)
Government’s Stand vs. Activist Concerns:
The Central Government defended the amendment, arguing that the 2019 definition was "ambiguous" and hindered the identification of "genuine victims." The state maintains that the law aims to protect those facing severe social exclusion due to biological factors beyond their control.Self-Claimed godman has gone rogue and insane in Nashik..!
However, the move has sparked a massive outcry:
Discrimination Claims: Opposition MPs have slammed the law for explicitly excluding Gays and Lesbians from its protective umbrella, calling it inherently discriminatory.
Violation of Autonomy: Activists argue that by mandating medical proof or specific socio-cultural markers, the law strips individuals of their bodily autonomy. Massive Hike in Premium Petrol, Commercial LPG, and Aviation Fuel Rates!
They contend that it undermines the 2019 inclusive framework, which recognized transgender identity regardless of whether an individual had undergone surgery or hormone therapy.
