Both presiding officers exercised their powers under Section 3 of the Judges (Inquiry) Act, 1968. Their separate and autonomous notifications stated that after a "careful and objective assessment of all relevant aspects," they refused to admit the notices. The signatories to remove CEC was consisted of 130 Lok Sabha members and 63 Rajya Sabha members. This was the first time in the history that a removal notice was formally served against a CEC.

The rejection by speaker has ignited both TMC and Congress, TMC’s MP Derek O’Brien questioned the lack of a detailed reason for the rejection, while Congress MP Jairam Ramesh referenced the resignation of former Chairman Jagdeep Dhankhar.
