United States: In a significant and dramatic turn of events, the United States Department of Justice (DOJ) is preparing to drop criminal fraud and bribery charges against Adani Group Chairman Gautam Adani. The significant shift follows a strategic renovation of Adani's legal defence, led by Robert J. Giuffra Jr., co-chairman of the elite Wall Street law firm Sullivan & Cromwell and one of U.S. President Donald Trump’s personal defence attorneys. The attorney took federal prosecutors through a detailed 100-slide presentation arguing that the U.S. government completely lacked basic evidence and proper jurisdiction to bring charges over actions tied to Indian solar energy contracts.

One of the presentation slides contained an unusual, high-value proposal, if the criminal charges were dropped, Adani would invest $10 billion into the American economy, a move projected to create 15,000 U.S. jobs. While prosecutors upheld that investment proposals do not dictate legal outcomes, the offer reportedly received a highly favourable response from senior DOJ officials.

While the criminal indictment is composed to be withdrawn, the civil fraud case brought by the SEC in November 2024 is being wrapped up through a financial settlement. As per consent judgments filed before the U.S. District Court for the Eastern District of New York, Gautam Adani has agreed to pay a civil penalty of $6 million, while his nephew, Sagar Adani, will pay $12 million. The $18 million total settlement is subject to final court approval.
